EMINENCE, KENTUCKY  JUNE 17, 2009

SPECIAL MEETING MINUTES

The City Council of the City of Eminence, Kentucky met in a public hearing and special session on Wednesday, June 17, 2009 at 6:30 p.m. at the Eminence City Hall Council Chambers with Mayor Jim Petitt and the following members present: Danny Meadows, Polly Troxell, Shawn Bright, and Leo Mason. Absent were Members Drane Stephens and Lee Ann Armstrong. Other individuals present were Attorney William Brammell, City Clerk Sandra Doane, Police Chief Carey Duncan, Police Major Kevin Kemper, Public Works Director William Smith, Doug Bates, Rodney Vanlandingham, Bob McGee, Joyce Meyer, Helen Moore, Doug Gingrich, Manda Gingrich, and Emma Jean Thomas.

The purpose of the meeting being called was to hold the public hearing on the proposed uses for the Municipal Aid and LGEA funds; to have the second reading of the fiscal year July 1, 2009 through June 30, 2010 budget ordinance; to vote on pay increases for the new fiscal year; to approve line item changes for the current fiscal year budget; to approve line item changes for the Fire Department current fiscal year budget; to hold the second reading of the Way annexation ordinance; and to hold a closed session to discuss the possible sale/purchase of property.

Subject: Public Hearing - Mayor Petitt called the MAP and LGEA public hearing to order at 6:30 p.m.

Individuals present for the public hearing were the same as listed above.

Mayor Petitt explained the required uses for the Municipal Aid Program funds stating they must be used on streets, roads and sidewalks. Mayor Petitt reviewed the proposed blacktopping expenditures from the Municipal Aid Program fund for the 2009/2010 fiscal year stating that the streets planned for possible blacktopping in the new fiscal year are Vernon Street, Blackaby Lane, Oldham Street, and Eminence Terrace. Oak Drive in the Arborview Subdivision is also scheduled but will not be done until we are sure the base will hold.

Mayor Petitt explained the required uses for the Local Government Economic Assistance funds stating they must be used for public safety.

Mayor Petitt asked for comments from the public and inquired if we had received any written comments concerning the proposed uses for either fund. Clerk Doane no written comments had been received for either fund.

With no other written or oral comments from the public regarding the proposed uses and budget for the MAP and LGEA funds, the public hearing was closed at 6:40 p.m.

Mayor Petitt called the special council meeting to order at 6:40 p.m. Individuals present for the special meeting were the same as listed above.

Subject: Budget Ordinance – Clerk Doane reviewed some changes with council which have been made to the budget since the first reading of the ordinance, which included increasing the beginning balances for some funds; adding the Homeland Security Grant as an income and corresponding expense item for the Police Department; increasing the transfer to Parks and Recreation due to a lower than anticipated beginning balance in this account; and increasing a transfer to the water and sewer reserve account. Attorney Brammell held the second reading of the budget ordinance for fiscal year July 1, 2009 through June 30, 2010. Motion made by Member Bright and seconded by Member Troxell to adopt the FY 7-1-09/6-30-10 budget ordinance as read and to approve the employees’ salary increases as included in the budget to be effective with the first full pay period in July. On a call of vote by Clerk Doane, voting “Yea” were Members Bright, Troxell, Meadows, and Mason. Motion carried.

Subject: Budget Line Item Changes – Clerk Doane reviewed the line item changes needed for the current fiscal year. Motion made by Member Meadows and seconded by Member Mason to approve the budget line item changes as reviewed and attached hereto. On a call of vote by Clerk Doane, voting “Yea” were Members Meadows, Mason, Bright and Troxell. Motion carried.

Subject: Fire Department Budget Line Item Changes – Clerk Doane reviewed the recommended line item changes needed by the Fire Department for the current fiscal year. Motion made by Member Bright and seconded by Member Mason to approve the Fire Department budget line item changes as reviewed and attached hereto. On a call of vote by Clerk Doane, voting “Yea” were Members Bright, Mason, Troxell and Meadows. Motion carried.

Subject: Way Annexation Ordinance – Attorney Brammell held the second reading of an ordinance annexing Kathryn Way’s property consisting of approximately six acres located at 811 Elm Street, 819 Elm Street and adjoining lot into the city limits. Motion made by Member Meadows and seconded by Member Troxell to adopt the ordinance as read. On a call of vote by Clerk Doane, voting “Yea” were Members Meadows, Troxell, Bright and Mason. Motion carried.

Subject: Closed Session – Mayor Petitt stated we need to go into closed session to discuss the possible sale/purchase of property. Motion made by Member Meadows to go into closed session to discuss the possible sale/purchase of property per KRS 61.810 (1) (b). Motion seconded by Member Mason. On a call of vote by Clerk Doane, voting “Yea” were Members Meadows, Mason, Bright and Troxell. Motion carried. Closed session began at 7:00 p.m.

Open session resumed at 7:15 p.m.

With no further business to be discussed, motion made by Member Bright and seconded by Member Mason to adjourn. All members present voted “Yea”. Meeting adjourned at 7:19 p.m.
