EMINENCE, KENTUCKY JUNE 9, 2008
The City Council of the City of Eminence, Kentucky met in a regular session on June 9, 2008 at 6:15 p.m. at the Eminence City Hall Council Chambers with Mayor Jim Petitt and the following members present: Danny Meadows, Shawn Bright, Drane Stephens, Richard Thomas, Jr., and George Armstrong. Absent was Member Treva Browning.
Pledge of allegiance held.
Mayor Petitt called the meeting to order at 6:17 p.m.
Subject: Introduction of New Business Owner – Mayor Petitt called upon Doug Bates who had asked to introduce a new business owner in town. Member Thomas spoke up stating that Mr. Bates was not allowed to speak since he was not on the agenda and the Mayor requires speakers to be listed on the agenda. Dr. Tim J. Lee introduced himself stating that he has relocated to Eminence after practicing chiropractic medicine for the past five years in Shelbyville. He is located at 20 East Broadway. His business name is Lee Family Chiropractic.
OLD BUSINESS:
Subject: Minutes – The minutes of the previous regular session held on May 12, 2008 and the minutes of the previous special session held on May 27, 2008 were reviewed. Mayor Petitt asked for any additions or changes to the minutes and with none forthcoming, stated they would stand approved as presented.
Subject: Bellsouth Utilities Easement – Attorney Brammell reported that he has contacted Bellsouth via e-mail on two different occasions concerning their need to purchase an easement from the City and also detailing our requirements that they be responsible for maintaining the service lines under their sub-station, but has had no response from their contact individual. He may need to send a certified letter again in order to get their attention back to this matter. Bellsouth has received the money back from the party they originally purchased the easement from who did not own the property.
Subject: Arborview Subdivision – Attorney Brammell stated he has sent letters to Todd Davis, attorney for Jim Dobson, requesting to set up a site visit to review the problems in the Arborview Subdivision but has had no response. Attorney Brammell stated he also contacted the attorney’s office by phone and has not had a return call yet. Attorney Brammell stated he hopes to have some information soon.
REPORTS:
Subject: Police Department Report – Police Chief Carey Duncan reviewed the monthly activity report with council which showed total activity of 232. Mayor Petitt commended Officer Hawkins who pulled a lady, who is on oxygen, out of a smoke filled house.
Subject: Property Ordinance Enforcement Report – Police Chief Carey Duncan reviewed the monthly ordinance violation report with council which showed twelve ordinance violations with five now in compliance with the ordinance.
Subject: Public Works Department Report – Mayor Petitt, in the absence of Public Works Director William Smith, reviewed the public works department monthly activity report with council. Mayor Petitt reported that a meeting has been held with the Division of Water to discuss a new sewer plant expansion project which would utilize a new biological treatment process. The state is requesting more information from Lemtec, who were also at the meeting, before a decision can be made. Lemtec has given a verbal 100% guarantee that their system will work.
Subject: Administrative Office Report - City Clerk Sandra Doane reviewed the monthly administrative office report with council. Clerk Doane reported that property tax liens will be filed this month on all 2007 unpaid property tax bills. The total unpaid 2007 property taxes as of the date of her written report is $9,896.24. Clerk Doane reported that the City has received the annual payment in lieu of taxes from the Housing Authority.
Subject: Fire Department Report – Member Meadows reviewed the monthly activity report with council. Member Meadows stated that the Fire Department has requested that we stress to the public the need for burn permits to be obtained from the Fire Department prior to any burning. Member Meadows reported that the Fire Department collected over $39,000.00 for the Crusade for Children which was down from last year, but still great considering the economy.
Subject: Community Center Report – Mayor Petitt reviewed the Community Center report with council. Mayor Petitt reported the total May attendance at the Center was 1,034.
Subject: Festivals Update – Member Bright reported that Music on Main for June will be this Friday, June 13 with Silver Wings (a local band) playing. A full color ad will be in the Henry County Local; a DJ will provide music prior to the band starting; and a new vendor, Choctaw’s Custom Indian Art, will be present. The National Guard will be providing a rock wall climb for the kids either this month or next.
Subject: Parks Committee Update – Member Stephens reported that a meeting has been held with the engineering firm on Wednesday with them being on site measuring, surveying and taking pictures in order to prepare specifications and cost estimates for the possible pool renovation. The committee is also evaluating the purchase of playground equipment for the park area.
NEW BUSINESS:
Subject: Warrants - The warrants presented for payment were reviewed. Motion made by Member Meadows and seconded by Member Bright to approve the warrants for payment as presented. On a call of vote by Clerk Doane, all members present voted “Yea”.
Subject: Mayor’s Update – Mayor Petitt stated he has spoken with Jodie McDonald about the land and water grant application and she has no information on when the funding will be released and the approved grants can be announced.
Mayor Petitt reported that he has spoke with Randall Embry about the TEA-21 grant with the same response as above.
Mayor Petitt reported that Chief Duncan has e-mailed a copy of the proposed revised property ordinance to all council who has e-mail. Anyone requiring a hard copy please come by City Hall to pick one up. Please review and offer any suggestions to Chief Duncan or Attorney Brammell.
Mayor Petitt reported he is waiting on a start date from the contractor for the city hall roof repairs. They have indicated they will be doing the work prior to June 30th, but that may not be very realistic at this point in time.
Mayor Petitt reported that he, Public Works Director William Smith, City Clerk Sandra Doane, and Attorney William Brammell have meet with Pleasureville Mayor Rodney Young and City Clerk Verna Stivers concerning evaluating the current contracts between the cities on the treatment of Pleasureville’s sewer and operation of Pleasureville’s system. More information will follow as this evaluation progresses.
Subject: New Business/Council - Mayor Petitt asked if any council member had anything they wanted to discuss. No one had anything at this time.
Subject: Special Called Meeting – Mayor Petitt reminded council of the special called meeting set for Wednesday, June 18, 2008 at 8:15 p.m. to hold a public hearing on the uses of municipal aid and local government economic assistance funds and to have a second reading of the budget ordinance.
Subject: Closed Session – Member Bright made the motion to go into closed session to discuss possible litigation. Motion seconded by Member Armstrong. All members present voted “Yea”. Closed session began at 6:40 p.m.
Open session resumed at 7:00 p.m.
With no further business to be discussed, motion made by Member Meadows and seconded by Member Bright to adjourn. All members present voted “Yea”. Meeting adjourned at 7:01 p.m.
