EMINENCE, KENTUCKY  OCTOBER 25, 2007

SPECIAL MEETING MINUTES

The City Council of the City of Eminence, Kentucky met in a special session on Thursday, October 25, 2007 at 6:30 p.m. at the Eminence City Hall Council Chambers with Mayor Jim Petitt and the following members present: Danny Meadows, Treva Browning, Shawn Bright, Drane Stephens, Richard Thomas, and George Armstrong. Absent were none. Other individuals present were Jonna Spelbring Priester with the Henry County Local, Jerry Clark, Jimmy Aynes, Attorney William Brammell and City Clerk Sandra Doane.

The purpose of the meeting being called was to review, discuss and possibly award the garbage franchise; discuss the alcohol ordinance allowing liquor by the drink sales; and to hold a closed session to discuss possible litigation.

Pledge of allegiance held.

Mayor Petitt called the meeting to order at 6:30 p.m.

Subject: Garbage Franchise – The recent garbage franchise bids were reviewed. Mayor Petitt stated he did some research on why Oldham County no longer has Rumpke. Per one of the County Magistrates, Rumpke took out a very negative advertisement against the County after the award was given to Industrial Disposal.

Member Meadows stated he feels the bid was requested twice with Rumpke not giving answers to specific questions. He also stated that we have had a good experience with Industrial Disposal with the only problems being with the truck being in the way at lunch time when the factories are letting out which creates a problem for workers getting back on time. Member Armstrong stated that his experience with Rumpke on a business level in LaGrange was not a very good one.

Motion made by Member Meadows to authorize the ordinance preparation by Attorney Brammell to award the contract to Industrial Disposal for the garbage collection franchise.

Attorney Brammell stated that we need the motion to address the recycling as well since it was part of the bid.

Attorney Brammell stated that from a citizen voice he would like to see the City enter into a contract for recycling as he has been doing this for a long time and feels it is very important for a community to recycle.

Member Bright stated that he does not see any way the large savings figure quoted by Rumpke of $164,029.80 could be correct. Clerk Doane stated that the only way this could be correct would be if Rumpke would offer their initial first year pricing for the entire five year contract. Member Bright stated he is not for mandatory recycling.

Member Stephens stated that he currently recycles at least 50% of their garbage and feels we should to this.

Mayor Petitt asked if we could negotiate a price for one 90 gallon garbage container and one 65 gallon recycling container versus the current two 90 gallon garbage containers and one 65 gallon recycling container currently bid by Industrial Disposal. Attorney Brammell stated he would not recommend doing so as it might be construed as a major change to the bid. Mayor Petitt stated he likes the recycling; however the garbage fee is going up approximately $5.00 a month and adding the recycling would increase the overall cost even more.

Additional discussion held on the recycling.

Member Meadows re-stated his motion to authorize the ordinance preparation by Attorney Brammell to award the contract to Industrial Disposal for the garbage collection franchise omitting the recycling part of the bid. Motion seconded by Member Bright. On a call of vote by Clerk Doane, voting “Yea” were Members Meadows, Browning, Bright, Thomas and Armstrong. Voting “Nay” was Member Stephens. Motion carried.

Subject: Alcohol Ordinance Amendment – The alcohol ordinance amendment to allow liquor sales by the drink was discussed. Member Bright stated he has received several calls against the requirement for the S.T.A.R. Training for all persons retailing and/or serving alcoholic beverages and he feels that until the state mandates this training he doesn’t want the City to include it in our ordinance. Member Meadows stated he has also received calls against this training requirement.

Member Armstrong stated the ABC training he and Mayor Petitt attended recently indicated that the S.T.A.R. training would be mandatory in about two years.

Member Thomas asked if this training includes tobacco as well as alcohol. Mayor Petitt stated they do train in tobacco sales but we are only requiring it for people who handle alcohol.

Member Bright stated he feels that the times allotted for the training also create a problem for most of the businesses.

Member Thomas stated he has been in this type business himself and hopes that most businesses here know what to do already. He has also had complaints about including this training and that we should let the State make it mandatory, but not us at this time.

Other discussion held including who would be fined for selling to a minor, how many illegal sales to minors have occurred, etc.

Member Browning stated the large turnover in employees would also create a burden on the employers. Member Stephens stated the employers would also have to pay the salary and travel of the person taking the training as well as the training fee.

The general consensus of council was for Attorney Brammell to take the S.T.A.R. training out of the proposed ordinance amendment.

Subject: Closed Session – Motion made by Member Bright and seconded by Member Meadows to go into closed session to discuss possible litigation. On a call of vote by Clerk Doane all members present voted “Yea”.

Open session resumed at 7:22 p.m.

With no further business to be discussed, motion made by Member Bright and seconded by Member Stephens to adjourn. All members present voted “Yea”. Meeting adjourned at 7:23 p.m.
