EMINENCE, KENTUCKY  JUNE 1, 2006

SPECIAL MEETING MINUTES

The City Council of the City of Eminence, Kentucky met in a special called session on Thursday, June 1, 2006 at 6:00 p.m. with Mayor Doug Bates and the following members present: Kevin Harris, Laura Whitney, Howard Roberts, Drane Stephens, Tom Ferguson, and Leeroy Winburn. Also in attendance were City Clerk Sandra Doane, Attorney William Brammell, Jim Pettit, Assistant City Clerk Robin Mullins, Police Chief Mount Hadden, Ronnie Kidwell, Mike Fitzgerald and Brooke Melville from Henry County Local.

The purpose of the special meeting being called was to adopt an emergency amendment to the alcohol ordinance; to discuss the Renaissance Faire opening; to hold a closed session for threatened litigation; and to discuss the scope of Council Member authority.

Mayor Bates called the meeting to order at 6:10 p.m.

Subject: Alcohol Ordinance Amendment – Attorney Brammell reviewed and read an emergency ordinance amending the alcohol ordinance to change the assignment of the duties of Alcoholic Beverage Control Administrator from the City Police Chief to such person as is appointed by the Mayor and approved by the City Council. The nature of the emergency is that it is necessary for security to be provided for an imminently occurring event wherein it may be a conflict for the Police Chief’s officers to serve off duty as security therefore. In order to avoid any such conflict and in order to assure that security will take place an emergency is declared and this ordinance amendment is adopted by vote of two-thirds or more of the legislative body and said ordinance shall take effect immediately. Motion made by Member Ferguson and seconded by Member Harris to adopt the ordinance as read. All members present voted “Yea”.

Mayor Bates stated he would like to re-appoint Leeroy Winburn as the Alcoholic Beverage Control Administrator. Motion made by Member Roberts and seconded by Member Whitney to approve the Mayor’s recommendation of Leeroy Winburn as Alcoholic Beverage Control Administrator. On a call of vote by Mayor Bates, voting “Yea” were Members Harris, Whitney, Roberts, Stephens, and Ferguson. Abstaining was Member Winburn.

Subject: Renaissance Faire – Mayor Bates reported that the Renaissance Faire is scheduled to open this Saturday, June 3rd. Mayor Bates reported on the nice article by the Henry County Local. As of Friday, May 26th there are 78 vendors scheduled to appear, 31 residents of the County have been hired and about 2,000 advance tickets have been sold. The Renaissance Faire has provided free advertising for everyone in Eminence thru their advertisements on the radio and television. Mr. Frederick has also had over 400,000 hits on their website. Mayor Bates reviewed the artist map which has been done to promote the Renaissance Faire and other points of interest in the County. Members Ferguson, Stephens and Harris stated that they have already had customers as a result of the Faire.

Member Roberts asked if the restaurant is complete as Mr. Fredrick’s presented it in his drawings to the Council. Mayor Bates stated this would be covered in closed session. Mayor Bates further stated that Stephen Humphrees, General Counsel to the ABC Legal Division, stated prior to our meeting to Chief Hadden and himself that Mr. Frederick can sell alcohol anywhere on the property and that it does not have to be consumed inside a restaurant structure and that a memorandum on such will come out after the Wednesday meeting of the ABC and the Attorney General’s office.

Member Winburn asked if passes for elected officials would be given out. Attorney Brammell stated it would not be appropriate for the elected officials to accept them even if offered.

Subject: Closed Session – Motion made by Member Harris and seconded by Member Winburn to go into closed session to discuss threatened litigation. On a call of vote by Mayor Bates, voting “Yea” were Members Harris, Whitney, Stephens, Ferguson and Winburn. Not voting was Member Roberts.

Closed session begun at 6:20 p.m.

Open meeting resumed at 7:40 p.m.

Subject: Scope of Council Member Authority – Attorney Brammell stated he will provide guidelines for Council Member authority at a later time.

With no further business to be discussed, motion made by Member Ferguson and seconded by Member Whitney to adjourn. All members present voted “Yea”. Meeting adjourned at 7:42 p.m.
