EMINENCE, KENTUCKY  DECEMBER 27, 2006

SPECIAL MEETING MINUTES

The City Council of the City of Eminence, Kentucky met in a special session on Wednesday, December 27, 2006 at 12:15 p.m. at the Eminence City Hall Council Chambers with Mayor Doug Bates and the following members present: Kevin Harris, Laura Whitney, Drane Stephens, and Tom Ferguson. Absent were Members Howard Roberts and Leeroy Winburn. Other individuals present were Mayor Elect Jim Petitt, Council Member Elect Shawn Bright, Attorney William Brammell, City Clerk Sandra Doane, and Public Works Director William Smith.

The purpose of the meeting being called was to approve/re-approve the opening and dedication of the street/public way between Depot Avenue and Bell Lane and related issues. The need to re-approve this motion was the absence of listing the meeting location on the previous special meeting notice.

Subject: Dedication of Street/Public Way and Location of Family Dollar Store - Motion made by Member Harris to accept the proposal of MAC Investors, LLC for location of a Family Dollar Store in Eminence and to have dedication by the City of the city’s portion of the strip approximately parallel to the Fire Department property on the north side as it connects Depot Alley to Bell Lane subject to the following terms:

  1. Agreement with Developer, MAC Investors, LLC, to dedicate the balance of the width necessary for pass way;
  2. Construction of roadway along said area by developer at developer’s expense to state/city road specifications;
  3. Developer’s construction of curb and gutter approximately parallel to said roadway on south side (city property);
  4. Acceptance of dedication by City upon satisfactory completion to specifications;
  5. Curb from property to island in Depot Avenue to be deleted (all per attached drawing which is incorporated herein by reference) and to direct Mayor to execute all documents necessary to effectuate. Motion seconded by Member Ferguson.

All members present voted “Yea”. Motion carried.

With no further business to be discussed, motion made by Member Whitney and seconded by Member Harris to adjourn. All members present voted "Yea". Meeting adjourned at 12:25 p.m.
