DOGS

§ 90.15 DEFINITIONS.

    For the purpose of this subchapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.

DOG. A member of the canine family six months of age or over.

DOG POUND. Any premises designated and operated by the Dog Warden under the authority of the county for the purpose of impounding and caring for dogs held under provisions of this subchapter.

DOG WARDEN. The officer employed, appointed, and authorized by the County Fiscal Court to primarily enforce the dog, animal, and livestock laws of the Commonwealth and this subchapter and to maintain and operate the County Dog Pound.

HUMANE SOCIETY. Any organization of the Commonwealth organized for the purpose of preventing cruelty and inhumane treatment of animals.

OWNER. Any person, partnership, or corporation that owns, keeps, or harbors a dog referred to herein.

RESTRAINT. A dog shall be deemed to be restrained if kept upon the premises of its owner or if accompanied by a person off the owner's premises and kept under that person's control.

§ 90.16 DOGS TO BE RESTRAINED; IMPOUNDMENT OF DOGS RUNNING AT LARGE.

(A) Every dog kept on premises within the city limits shall be restrained. Unrestrained dogs may be taken by the County Dog Warden to the dog pound and there confined in a humane manner not less than seven days unless claimed by their owners. If the owner can be identified said owner shall be immediately notified by the Dog Warden to reclaim the impounded dog. If said dog is not claimed within seven days, it shall be humanely destroyed or otherwise disposed of. If these dogs are sold to individuals or institutions, the money is to be turned over to the Henry County Fiscal Court.

(B) The County Dog Warden or any peace officer of the city shall issue to the owner of any dog found off its owner's premises a citation giving notice of a charge of violation of this section. Upon conviction of violation of division (A) above, the owner shall be liable to the county for a fine as set forth in § 90.99.

§ 90.17 RECLAIMING IMPOUNDED DOG.

    An owner reclaiming an impounded dog shall pay a fee of $5 to the Dog Warden for impoundment the first time and $15 for each subsequent impoundment. The owner shall also pay $3 per day board bill for each day the dog is impounded by the Dog Warden. Proof of vaccination for rabies shall be furnished and current license shall be required before any impounded dog is released to an owner. Such owner shall, upon reclaiming the impounded dog, be issued a citation for any violation of this subchapter.

§ 90.18 FEMALE DOGS IN HEAT TO BE CONFINED.

    Every female dog in heat shall be confined in a building or secure enclosure in such a manner that such female dog cannot come into contact with another dog except for planned breeding.

§ 90.19 CONTROL OF DOGS REQUIRED TO PREVENT CERTAIN ACTIVITIES.

    No owner shall fail to exercise proper care and control of his dog so as to prevent the following actions by the dog: chasing of vehicles, excessive, continuous or untimely barking or howling, molesting of passerby, attacking other domestic animals, trespassing upon school grounds, trespassing upon private property, or damaging property by any nature.

§ 90.20 HUMANE TREATMENT OF DOGS.

(A) No owner shall fail to provide his dog with good and wholesome food and water, proper shelter and protection from weather, veterinary care when needed to prevent suffering, and with humane care and treatment. If any dog is restrained by a chain, leash, or similar restraint, such chain or restraint shall be designed to prevent the animal from choking or strangling itself.

(B) No person shall beat, cruelly ill treat, torment, overload, overwork or otherwise chase any dog, or cause or permit any dog fight, or other combat between animals and dogs.

(C) No owner shall abandon a dog. abandonment consisting of leaving a dog for a period in excess of 24 hours without providing someone to feed, water and check on the dog's condition. In the event that a dog is found so abandoned, such dog may be taken by the Dog Warden and impounded in the dog pound. Such dog, if taken from private property, shall be kept for not less than 30 days with the same procedure otherwise to be followed as in §§90.16 and 90.17. In the event that a dog is so abandoned, the owner, rather than the person, if any, who he has charged with the animal's care, shall be liable for violation of this section.

(D) No person shall crop a dog's ears except a licensed veterinarian.

(E) No person shall place any poisonous substance which may be harmful to a dog as described herein in any location where it may be readily found and eaten by any such dog.

(F) No person shall drop or abandon any dog in the city.

§ 90.99 PENALTY

(A) Any person who violates any provision of this chapter for which another penalty is not already otherwise provided shall be fined not more than $250 for each offense. Each day the violation exists shall constitute a separate offense.

(B) Any person who violates § 90.03 shall be fined not more than $500, imprisoned for not more than 12 months, or both for each offense. (KRS 525.130)

(C) Any person who violates § 90.04 shall be guilty of a misdemeanor and shall be fined not less than $100 nor more than $500. (KRS 436.600)

(D) Whoever violates § 90.07 or § 90.08 shall be fined not less than $10 and not more than $50 for each offense. Each day that said person is not in compliance with those sections shall be treated as a separate offense. (Ord. 84-840-011, passed 10-2-84)

(E) Whoever violates § 90.16 shall be fined not less than $10 nor more than $100.

(F) Any person violating any provision of § 90.15 through § 90.20 (excepting § 90.16) shall be deemed guilty of a misdemeanor and shall, upon conviction through the Henry District Court, be punished by a fine of not less than $10 nor more than $100 or be imprisoned for not less than five nor more than 60 days or both so fined and imprisoned. If any violation be continuing, each day's violation shall be deemed a separate offense.
